TERMS AND CONDITIONS OF PAYMENT
CYBER LAB VIP HACKTRACE RANGES

These Terms and Conditions of Payment (" Terms and Conditions") and any other rules or policies available on the Platform (as from now on defined) constitute binding agreements ("Agreement") under Applicable Law (as from now on defined) between the User and PT Spentera Edukasi Internasional ("We").

By registering, accessing or using the Service, you represent that you have read, understood and agree to be bound by this Agreement and/or any other Terms imposed by Hacktrace Ranges. You are only permitted to use the Service, regardless of whether your access is intentional or unintentional, if you agree to all applicable legal terms in this Agreement and any other Terms enforced by Hacktrace Ranges.

Hacktrace Ranges reserves the right, at its sole Terms, to change, modify, add, or remove portions of this Agreement at any time without further notice. If Hacktrace Ranges does this, Hacktrace Ranges will post the changes to the Agreement on this Platform. Your continued use of this Platform following any such changes constitutes your acceptance of the revised Agreement and any other Terms imposed.

If you do not comply with the Agreement and/or any other Terms imposed at any time by Hacktrace Ranges, Hacktrace Ranges reserves the right to immediately cancel or terminate your access to the Service (or any part thereof) and/or your user account, if any.

You agree that Hacktrace Ranges is not responsible for your activities that violate the terms of the Hacktrace Ranges platform.

1. DEFINITION

   1. PT Spentera Edukasi Internasional, here in after referred to as "We" and "Hacktrace", is a limited liability company established under the laws of the Republic of Indonesia.

   2. Hacktrace Ranges is an application that can be accessed through computer devices by Users through the Hacktrace Ranges platform, including but not limited to learning services, training, purchasing learning materials through video suggestions and hacking simulations on Hacktrace's Lab Online.

   3. Services are services found on the Hacktrace Ranges platform.

   4. The platform is the Hacktrace Ranges website at https://www.hacktrace-ranges.id, a web application developed by PT Spentera Edukasi Internasional.

   5. User, hereinafter referred to as "You", is any person, Company, legal entity, or corporation who performs the registration procedure as a customer to use the Services provided on the Hacktrace Ranges platform.

   6. VIP Member is a premium service provided to Hacktrace Ranges Users who subscribe to the Hacktrace Ranges Service with special features and benefits to be able to access and use paid services and content contained in Hacktrace Ranges in accordance with these Terms and Conditions.

   7. Online Training is any and/or all training materials created and/or compiled by us, including but not limited to material, text or writing, images, videos, illustrations, sound or audio recordings, titles, descriptions and/or any data in any form provided by Hacktrace Ranges are copyrighted and are not permitted to be distributed.

   8. Virtual Cyber Lab, covering offensive and defensive as a learning simulation media for Users in learning practice activities and training on hacking techniques and cybersecurity for beginners and professionals.

   9. Discussion Forum is an online discussion platform through the Discord Application that can be used by Users to interact with instructors and other Users.

   10. Subscription Plans are subscription plans offered by Hacktrace that provide access to different materials, features, and fees for a certain period of time, with different validity options.

   11. Transaction is any purchase and/or Payment activity carried out by the User through Hacktrace Ranges.

   12. Security Code is the User ID. Password verification codes, which include OTP codes we provide, allow you to access your Hacktrace account.

   13. Applicable law is any legislation, statute, code, law, regulation, rule, order, decree, ruling or decision of any government agency.

   14. Intellectual Property Rights means patents, trademarks, service or service marks, copyrights, rights in designs, know-how, or other intellectual or industrial property rights, whether registered or unregistered.

   15. Personal Information is Information about the User that is personally identifiable and collected through the Application, such as name, address, date of birth and occupation, telephone number, email address, licence and/or the like, and other information that may identify you as a User of the Application.

   16. Privacy Policy is a policy that governs the manner in which Hacktrace Ranges collects, manages, and uses User Data and Information in the Application.

2. ACCOUNT

   1. You hereby declare that you are a person who is capable and able to bind himself in a lawful agreement.

   2. In order to access and/or navigate the Hacktrace website and Hacktrace Ranges service, you must register and create a Hacktrace account

   3. By registering and using Our services, You agree to:

      1. Provide true, accurate, current and complete Information and Personal data, including full name, valid email address, telephone number and other information as requested in the registration form provided.

      2. Maintain the accuracy and completeness of your Information and personal data by making any necessary changes or updates from time to time.

   4. You are solely responsible for the security and confidentiality of your Account, including maintaining the confidentiality of your username and password for all activities that occur within you. You agree not to share your account information with any other party or authorise any other person.

   5. You are personally responsible for maintaining the confidentiality of your Account and password for all activities that occur under your Account.

   6. Hacktrace will not ask for a username, password, OTP code or verification SMS code for any reason.

   7. You agree not to provide or share any data or data containing the username, password or OTP code to other parties or parties on behalf of Hacktrace. We are not responsible if you inform or share the data with other parties either intentionally or unintentionally, and thus, we will not provide compensation and/or liability in any form to the User or any party for all responsibilities, claims and demands in connection with the knowledge of the data but not limited to the username, password, or OTP security code by other parties.

   8. You may only use Our services for purposes that are lawful and authorised by Hacktrace. You may not use your Account for purposes that are unlawful or contrary to our terms and policies.

   9. You are only allowed to have 1 (one) Account on Hacktrace, so you cannot transfer your Account to another party. We do not allow you to create multiple accounts or fake accounts, and we reserve the right to reject multiple account creation activities.

   10. We reserve the right to refuse to facilitate the service if we know or have sufficient reason to suspect that you have transferred or allowed your Account to be used by someone else. If you are using the service on behalf of an entity, Company and/or organisation, you agree to these terms on behalf of that entity, Company and/or organisation and undertake that you have the authority to bind that entity, Company and organisation or organisations to these terms. In these terms, "you" refers to the entity, Company and/or organisation you represent.

   11. If you have "logged out" of your Account, you will need to enter the email address you provided when you registered and enter your password.

   12. You hereby declare that Hacktrace will not be responsible for any losses or problems arising from the misuse of your Account caused by you, but not limited to lending your Account to other parties, providing or showing verification codes in the form of OTP, email and password registered on the platform, accessing links sent by other parties, or other User negligence that results in losses or problems with your Account.

3. ACCOUNT USAGE

   1. You need an account for most activities on Our Services, including purchasing training, registering for courses, and/or viewing videos that constitute training content. At the time of registration, You must provide accurate and complete Information, including a valid email address. You are prohibited from providing your Account to any other Party, transferring, altering, downloading or reselling the video content Materials in any way.

   2. We offer Lab services, including:

      1. Lab Defensive is a simulation service we provide that can be accessed within a certain period of time based on the subscription package. This service aims to identify and mitigate security vulnerabilities in information technology systems and infrastructure.

      2. Lab Offensive is a simulation service provided by us that can be accessed within a certain period of time based on the Subscription Package to simulate realistic cyber-attacks with the aim of identifying vulnerabilities and security gaps in information technology systems and infrastructure.

   3. Video Content available on the Hacktrace website includes:

      1. On-demand Video is video content that can be accessed within one month of the course period; if you want to extend the period, you must extend the video content.

   4. We do not provide lifetime access licences; access to the service is only granted as long as the Customer is within the terms of the selected subscription service.

   5. We only grant You (as a Subscriber) a limited, non-exclusive and non-transferable licence to access and view the course training and related content for which You have paid the full fee, solely for non-commercial personal, educational purposes through Our Services, subject to these Terms and Conditions and any other restrictions or requirements that may apply to a particular course or feature of Our Services. You may not reproduce, redistribute, transmit, disseminate, sell, broadcast, rent, share, loan, modify or copy the materials, adapt, edit, create derivative works, sublicense, attempt to decompile or reverse engineer any software contained on the Hacktrace website, remove copyright from the Materials or transfer or use any course unless We expressly authorise You to do so in a written Agreement signed by an authorised Hacktrace representative.

   6. You are prohibited from falsifying or providing inaccurate or misleading Information, including Information regarding age, in order to gain access to the Service or content that has been restricted based on age or other requirements. Any violation of this provision may result in unilateral account termination or suspension by Us.

4. PAYMENT

   1. PRICE

      1. You understand and agree that we offer the price as stated on our website page. We offer several subscription package options as follows:

         1. Package 1 (one) Month;

            • provides access to materials and other training resources for 1 (one) month.

         2. 3 (three) Month Package;

            • provide access to materials and other training resources for 3 (three) months.

         3. 6 (six) Month Package

            • Provide access to training materials and resources for 6 (six) months

            • an additional bonus of free access for 1 (one) month.

         4. 12 (twelve) months package, 1 (one) month free.

            • Provide access to training materials and resources for 12 (twelve) months,

            • an additional bonus of free access for 1 (one) month.

         5. On registering for the service, you agree to pay the total fees payable as stated on the payment page, which is based on the Subscription Plan you have previously selected.

         6. We reserve the right to change fees or offer new subscription packages at any time without prior notice. Fee changes will not apply retroactively to previously paid subscriptions.

         7. The applicable price is the price listed on the subscription package page at the time of purchase. The price will remain valid throughout the validity period of the subscription package you purchased.

         8. We will provide notice on our website of any changes to fees or new package offerings before they become effective.

         9. By continuing your subscription or renewing your subscription plan after notification of a change in fees, you agree to the new fees.

   2. PAYMENT TRANSACTIONS

      1. You must make payment transactions through procedures and transaction methods that have been determined and provided by Hacktrace. You can make payments through the third Payment Gateway method, which has been determined by Hacktrace.

      2. We reserve the right to add, change or remove such payment methods at any time at our discretion.

      3. You are required to make immediate payment no later than 1 x 24 hours after you have checked out. If, within that time limit, payment has not been made by you, Hacktrace has the authority to cancel the transaction. You have no right to make a claim or demand for the cancellation of the transaction made by Hacktrace.

      4. You are required to double-check the payment amount with the payment invoice shown on the payment page.

      5. You will get a payment notification via the email you have registered on the Platform.

      6. You fully understand and agree that all transactions are carried out through transaction procedures that have been established and provided by Hacktrace. Hacktrace is not responsible for any loss or failure arising from transactions carried out by Users outside of the transaction procedures that have been established and provided by Hacktrace.

      7. In the event of payment failure or refusal, We reserve the right to cancel or suspend Your access to Our services until payment is successfully completed.

      8. The deadline for activating the package after purchase is no later than 30 (thirty) days after payment is made.

      9. All purchases received by us are final and non-refundable for any reason.

5. PERSONAL INFORMATION

   1. By using Our services, You may provide the Company with various Information, including Personal Information (hereinafter "Information") that You submit through Our services.

   2. The collection, storage, processing and use of your Personal Information, such as the name, email address and mobile phone number you provide when opening an Account, is subject to the Privacy Policy, which is part and parcel of these Terms and Conditions.

   3. These Terms and Conditions do not grant Us any rights to Your Information or intellectual property, except for limited rights necessary to operate and provide the Services.

   4. For security reasons, you should not share your email address or personal information with other users.

6. USE OF ACCOUNT SERVICES

   
   

   Our Services will be provided to Users who have fulfilled the following requirements:

   1. Users have access rights by making payments that have been determined by us through transfers to the payment gateway on the website/application that has been determined by us.

   2. Only Users who have a Hacktrace account can use our services.

   3. You are fully responsible for all activities and consequences arising in connection with the use of accounts and passwords.

   4. You are obliged to maintain the confidentiality of passwords with great care. We have the right to consider and treat all activities that have been carried out through the Account as legitimate activities carried out by you. The User is responsible for all losses and legal consequences arising from errors or omissions in maintaining the confidentiality of the Account password. The User shall immediately notify the Company of any suspected or actual unauthorised use of the Account or password or any known breach of security.

7. PROHIBITED USE

   
   

   You may only use our Services for lawful purposes. Your prohibited uses of Our Services include:

   1. Intentionally use the platform or skills gained from Hacktrace services for unlawful activities.

   2. Use the knowledge gained from Hacktrace Services to design or deploy malware.

   3. Send, knowingly receive, upload, download, use or reuse material that does not comply with our content standards.

   4. Distribute or transmit unsolicited or unauthorised advertising or promotional material, as well as other similar forms of solicitation (such as spam).

   5. Disseminate and/or transmit and/or make accessible electronic Information and/or electronic documents containing offences against decency.

   6. You are prohibited from creating and/or using hardware/software and/or other tools, but not limited to automated devices, that aim to access or use services on Our system unlawfully. Prohibited actions include but are not limited to:

      1. create or use multiple accounts unlawfully or without Hacktrace's permission;

      2. manipulate devices or systems in any way that is intended to harm or disrupt Hacktrace's operations;

      3. copy content from the service without the express written permission of Hacktrace;

      4. spamming, sending large volumes of electronic communications, or sending chain letters without Hacktrace's consent;

      5. Collecting or stealing user data;

      6. Engage in any other activity that could reasonably be judged to be an act of manipulation, interference, or abuse of the Hacktrace Services and systems.

8. TERMINATION OF SERVICE

   1. Hacktrace reserves the right to terminate, limit or suspend your access to Our services, either temporarily or permanently, including access to courses, learning materials, simulations and other features, immediately, without prior notice and without obligation to refund any funds if User violates the Terms of Use, Payment Policy, or any other applicable policies, including but not limited to:

      1. Breach of these Terms and Conditions or other applicable policies;

      2. Actions that violate the law or harm other parties;

      3. Misused or improper use of services;

      4. Failure to make required payments;

      5. Requests from government authorities or authorised legal entities;

      You will lose access to and the right to use our services. However, the paid subscription will remain valid until the expiry of the validity period unless You submit an early termination request. We may decide to prohibit You from opening a new account at a later date, depending on the reason for terminating the previous Account.

   2. We will not be liable for any loss or damage you may incur as a result of the termination of the service unless it is caused by our gross negligence or fault.

9. CONFIDENTIALITY AND PRIVACY

   1. We are committed to making our best efforts to protect the security and integrity of Our Users' data from time to time. We implement strict security measures to prevent unauthorised access, use or disclosure of your personal Information.

   2. We use strong encryption technology to secure the transmission of data between your device and our servers. Sensitive Information such as passwords and payment data is encrypted to protect it from unauthorised interception and access.

   3. We respect your privacy and will only collect the Personal Information necessary to provide our services. We will not sell, rent or otherwise provide your personal information to third parties without your permission unless required by applicable law

   4. Access to user information is restricted to Hacktrace employees and contractors who have a legitimate business need to access such Information. Everyone who has access must adhere to strict confidentiality obligations.

   5. User data is stored on safe and secure servers with multiple layers of physical and digital security controls. We perform regular data backups to ensure data availability and integrity.

   6. Hacktrace does not knowingly collect Personal Information from children under the age of 13. If you are a parent or guardian and have concerns about your child's Personal Information, please contact us.

   7. We comply with all applicable laws and regulations relating to data protection and user privacy. We may disclose user information if required by valid legal processes, such as a court order or a request from law enforcement authorities.

   8. In the event of a security breach involving your Personal Information, Hacktrace will provide notice to you in accordance with applicable legal requirements and will take appropriate action to protect your interests.

10. INTELLECTUAL PROPERTY RIGHTS

    1. All Intellectual Property Rights associated with Our Services, but not limited to names, logos, program code, designs, brands, text, images, videos, content, learning materials, technology, features, databases, processes and business models, remain the property of Hacktrace Ranges and Hacktrace Ranges' licence right holders, and are protected by Copyrights, Trademarks, Patents and Intellectual Property Rights owned by Hacktarce Ranges and do not entitle you to own any Intellectual Property Rights owned by Us. We own all rights and interests in the service, including the intellectual property rights associated with all features contained therein.

    2. By agreeing to these Terms and Conditions, We grant You a non-exclusive, limited, revocable, non-transferable, non-assignable (non-sublicensable) limited licence to:

       1. Access and use our services for personal use during your subscription period;

       2. Access or use the content, Information and related materials available on Hacktrace's services for customer and non-commercial purposes only. Any other rights and privileges not expressly granted in these terms of use are reserved to us or our licensors.

    3. You agree not to use, copy, distribute, modify, or create derivative works from any intellectual property rights owned by Us, including but not limited to trademarks, copyrights, patents, trade secrets, or other confidential Information, without obtaining prior written consent from Us.

    4. You are prohibited from performing actions related to Our services, but not limited to:

       1. Copy, distribute or broadcast the content without authorisation, Modify, alter or create derivative works from the content;

       2. Use the content available in the Application beyond what is expressly permitted by these Terms and Conditions and Applicable Laws, including duplicating, distributing, modifying, broadcasting, reusing, transferring or creating works of content on the Application and any documentation related to the Services without the express written permission of Hacktrace Ranges.

    5. Hacktrace Ranges grants you a limited licence to use the Hacktrace Ranges website, or you are granted a limited licence to download and print copies of content from the Hacktrace Ranges website or the App for personal use. In the event that you copy or print pages from the Hacktrace Ranges site or the App, you must ensure that you include any Hacktrace Ranges copyright or trademarks in the content you copy.

    6. These Terms and Conditions do not grant any party, either express or implied, any ownership or other interest in any Intellectual Property Rights belonging to any particular party which may be included or contained herein. It is understood that such Intellectual Property Rights shall at all times remain the exclusive property of the owner thereof, and such party shall retain all goodwill instilled through the use of the Intellectual Property Rights.

11. PERSONAL DATA PROTECTION

    1. In the process of purchasing and using Our services, You may be asked to provide personal Information such as name, email address, phone number, and payment information.

    2. We are committed to protecting the confidentiality and security of your personal data. We will use your personal Information only for purposes related to the provision of Our services, such as order processing, payment verification, and service-related communications.

    3. We will not provide your personal Information to third parties without your consent, except where required by law or to protect our or others' rights, property or safety.

    4. We take adequate security measures to protect your personal Information from unauthorised access, use or disclosure from time to time.

    5. You are responsible for maintaining the confidentiality of The user information and password you use to access our services. You must notify us immediately if you become aware of or suspect any breach of security or unauthorised use of your Account.

12. LINKS TO THIRD PARTIES
    

    Where our services contain links and access to websites and other content provided by third parties, we have no control over the content of those websites or resources. We are not responsible for any part of the content provided by third parties. Your access or use of such third-party content constitutes your Agreement to be subject to the terms and conditions and privacy policies set forth by such third parties.

13. YOUR RESPONSIBILITY

    1. Subject to the provisions of these Terms and Conditions, you hereby agree and assume responsibility for the following:

       1. Registration for the Hacktrace Ranges service is carried out by the User.

       2. You are responsible for keeping your account username and password secure.

       3. You must ensure the accuracy of the data you input into our system.

       4. You must be responsible for all content and activities that occur on your Account, whether by you or other parties using your Account, in a way that does not violate and or conflict with these terms and conditions.

       5. For all losses and/or claims and claims of any party arising from the use of services through your Account, both by you and other parties who use your Account, in a manner that is contrary to these terms and conditions. Privacy or applicable laws and regulations, including but not limited to anti-money laundering, anti-funding for criminal activities, crime, fraud in any form (including but not limited to phishing activities and/or social engineering), infringement of intellectual property rights, and/or other activities that harm the community and/or other parties anywhere or that can or are considered to damage our good name, then you must be fully responsible for all such losses.

       6. In the event of an incident as referred to in letter (e) above, You are obliged to fully indemnify Us if there are claims from third parties, losses, payments or costs of any kind incurred, experienced or submitted to Us at any time and from time to time either directly or indirectly related to the implementation of the use of Our services, including but not limited to legal counsel fees and court costs incurred by Us.

    2. That Users shall not modify or copy materials, manipulate, hack, copy data, use materials for commercial purposes, remove copyrights, decompile or reverse engineer and/or take any other unlawful actions for personal unlawful purposes that result in alteration of Hacktrace data or disruption of the Information Technology systems of the Hacktrace Ranges Service.

    3. We do not guarantee that our Services will be secure or free of bugs or viruses. You are responsible for managing the information technology, computer programmes and services you use to access our Services. You should use your own anti-virus software.

14. LIMITATION OF OUR LIABILITY

    1. The services We provide are as is and as they are, and You understand that We make no representations or warranties of any kind that the services will always be timely, free from interruption, accuracy, availability, completeness, and security of services that will meet Your needs.

    2. Whilst we endeavour to ensure that the learning materials provided are accurate and up-to-date, We do not warrant the accuracy, completeness or reliability of such materials. You are responsible for evaluating and using the Information wisely according to your situation and needs.

    3. The Service may be subject to limitations, delays and/or other problems associated with the use of the internet and electronic communications, including your device, service provider, not being connected to the internet, being out of range, being switched off, or malfunctioning. We are not responsible for any delays, delivery failures, damages or losses caused by such problems. We are not responsible for any disruption or loss that may arise from such problems.

    4. We shall not be liable to any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, however foreseeable, arising under or in connection with:

       1. Use of, or inability to use, our services; or

       2. Use of or reliance on any content displayed on our services.

    5. We are not responsible for the misuse of knowledge obtained by the User from Hacktrace Services that is used to commit cybercrime and/or perform actions contained in the prohibited uses in these terms and conditions.

    6. We are not liable for any loss or damage caused by viruses, distributed denial of service (DDoS) attacks or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use or downloading of any content from our services and other websites to which you link to those services.

    7. We have no obligation to monitor your access or use of the service. However, we will continue to monitor to ensure the operation of the services and to ensure your compliance with these terms and conditions, applicable laws and regulations, court decisions, and/or regulations of administrative or other government bodies.

    8. We are not responsible for the content, privacy policies, or practices of websites linked to Our services. Such links do not constitute Our endorsement of those sites. We are not liable for any loss or damage arising from your use of this website.

    9. We shall not be liable to you or any third party for any changes, price changes, suspension or discontinuance of the service.

    10. You agree to release Us from all claims, demands, lawsuits, and damages of any kind and from any party arising in connection with Our use of Personal Information or data based on these Terms and Conditions or based on the approval, acknowledgement, authority, power, and/or rights that You have given to Us;

    11. We are not responsible for any delay, failure, interruption or unavailability in the provision of Our services caused by circumstances beyond our control, including but not limited to natural disasters, war, riots, government policies, banking system failures, monetary crises, changes, additions, subtractions, transmissions, damage, loss, removal, concealment of Our systems, devices, or services caused by the actions of a party intentionally and without rights or against the law, interference or unavailability of third party services including internet network disruptions, power, telecommunications and electricity on an ongoing basis, or other matters beyond Our control.

15. OTHER CONDITIONS

    1. You understand and agree that these Terms and Conditions constitute an agreement in electronic form. Your action of pressing the 'Register/Check' button when opening an Account or the 'Login' button when accessing an Account constitutes your active Agreement to be bound by these Terms and Conditions, which are valid and legally binding as long as you use the Service.

    2. You may not assign or transfer any of its rights or obligations under these Terms and Conditions without Our written consent.

    3. In the event that any part of this provision is declared invalid, void or unenforceable based on a court decision or applicable laws and regulations, it shall not affect the validity or enforceability of the remaining enforceable provisions. The provisions that are still enforceable will continue to apply and bind the parties.

    4. We reserve the right to change or update these Terms and Conditions at any time by providing you with reasonable notice. Your continued use of such Services after such updates will be deemed to be your acceptance of the changes made.

    5. You will not raise any claim or objection to the validity of the Terms and Conditions or Privacy Policy made in electronic form.

    6. These Terms and Conditions shall survive even after any temporary suspension, permanent suspension, deletion of the Service, or after the termination of the Agreement between You and the Company.

    7. If one of the provisions in these Terms and Conditions cannot be implemented, it will not affect the validity and enforceability of the other provisions.

16. APPLICABLE LAW

    These Terms and Conditions shall be governed by and construed in accordance with the Laws of the Republic of Indonesia. You agree that any legal action or dispute that may arise relating to the site and/or these Terms and Conditions shall be resolved exclusively within the jurisdiction of the courts of the Republic of Indonesia.
